 TMobile MDA Compact problems - help!

I have been having problems with the MDA compact – had it repaired once from HTC – same problem again (calls cutting off + speaker unit screwed up) – Tmobile say they wont replace / exchange the phone. Is there anything I can do apart from getting another repair? Are TMobile obliged to do more than just repair the phone. I guess not.

As I understand it legally not.

They are within their rights to offer a repair.
