Apple posts Samsung case judgement on UK website


Apple have posted their court-mandated acknowledgement that Samsung didn't copy the iPad design on their UK website.

Linked from their homepage and available to view in full on it's own page, completely free of any Apple branding, the statement seems to comply with the letter of the judgement if not the spirit, stating...

On 9th July 2012 the High Court of Justice of England and Wales ruled that Samsung Electronic (UK) Limited’s Galaxy Tablet Computer, namely the Galaxy Tab 10.1, Tab 8.9 and Tab 7.7 do not infringe Apple’s registered design No. 0000181607-0001. ...and then duly sticking the knife back into Samsung...

The informed user's overall impression of each of the Samsung Galaxy Tablets is the following. From the front they belong to the family which includes the Apple design; but the Samsung products are very thin, almost insubstantial members of that family with unusual details on the back. They do not have the same understated and extreme simplicity which is possessed by the Apple design. They are not as cool.

...in a case tried in Germany regarding the same patent, the court found that Samsung engaged in unfair competition by copying the iPad design. A U.S. jury also found Samsung guilty of infringing on Apple's design and utility patents, awarding over one billion U.S. dollars in damages to Apple Inc. So while the U.K. court did not find Samsung guilty of infringement, other courts have recognized that in the course of creating its Galaxy tablet, Samsung willfully copied Apple's far more popular iPad.

Ouch!

The judgement, which can be viewed in full at BAILII, as well as requiring the link to be present on the Apple homepage for 6 months, also requires Apple to 'publish in a font size no smaller than Arial 14pt the notice specified in Schedule 1 to this Order on a page earlier than page 6 in the Financial Times, the Daily Mail, The Guardian, Mobile Magazine and T3 magazine.'

So the public humiliation isn't quite as humiliating as Samsung might like... I suspect we might not have heard the last of this one... :)

Edit: Just read that the 14pt bit only applies to the ad in the paper. I'll go away now :)
I just heard Apple has patented:- reading and the writing down of words....

Anyone doing either of this things on non apple products will get taken to court.

(just joking)  but this is about how apple operates.  It seems.

They are clearly very very intimiated by android products and their (more) reasonable prices.
Jobs said he'd crush android.  It looks unlikely and more likely the reverse might happen.
