Ok.. this is wierd.

M5000 - fully charged, nothing running, nothing installed in FLIGHT mode....now this happens...

Use the device for a few mins every hour or so - no problem

dont use the device - battery flat in a few hours. So flat that I can't even boot it.

Now.. the even more wierd thing is that this drain seems to be worse when i put the unit into the carry case it comes with. I have no idea why this may be the reason.. it just does it.

I can only think that the case is pressing on something and thats making a short circuit. but I'm lost trying to work it out!

It's not under Orange care, but under warranty.. how can i get it looked at.. i've been calling HTC but they just dont get back to their voicemail messages.

Anyone got any idea wha on earth this can be?

No idea what's causing it but you don't need to call HTC to get it delt with under warranty. You got the device from Orange and its Orange branded, your well within your rights to demand a warranty repair through Orange. This is the same with any device even if its not Orange branded. Your contract of sale is with the vendor of the device not the manufacturer and under british consumer law if it goes faulty within the warranty period your can take it to whoever sold it to you and get them to return it the manufacturer for repair.

Demand?

There's no need to be so uppity. SImply take your M5000 to an Orange shop WITH a dated proof of purchase which shows the IMEI. Job done.

Actually by demand I do mean demand, if necessary. Not being uppity or anything but I had one of the original Orange SPV phones which developed a keyboard fault. Called CS about it and they tried to palm me off with the "you should have taken out orange care" line. I had to politely, but firmly "demand" my consumer rights from them before they agreed that it was indeed a warrenty issue, and that they were in fact required to deal with it whether I had taken out an insurance policy through them or not. It really does pay to know your rights.

this is what i thought.. they've palmed me off with the same excuse all the time..

'You're not covered with us now so here's an 0871 number to call'

I keep asking is there nothing that they can do, seeing as it's their device and they obvioulsy tel me nothing.

What will the Orange shop do? My proof of purchase is just on my file with Orange cos it was an upgrade from them...

So what is the 'killer' line i shoudl say to OCS about this to sort me out a replacement?

Sorry for the delay in answering, call them up again and say that you are going to contact trading standards. They sold you a phone for use on a 12 (or even 18 month) contract, if it stops working before the end of the contract then it obviously wasn't "fit for purpose" as it didn't last until the end of the contract. If they try to say that you should contact HTC again for a repair just politly point out to them that you have a contract of sale with Orange, not HTC, but you would be quite happy for orange to to contact HTC on your behalf since you can't seem to get in contact with them. If the first person you get in contact with is unwilling to help you then ask to speak to their supervisor, and always get the persons name and if possible their employee reference number.

Thanks so much, I will call them now and sort this out. I forgot how great you folks are.

Cheers

I'll let you know what happens!

Well.. just realised the problem is that it's not actually under contract because I upgraded early, so there's no contract at all. Therefore Orange tell me there's nothing that they can do because there isn't even a contract with them!

Grrr..painful.

If they took money from you in exchange for a phone then that is a contract of sale, whether or not you took out a new phone contract or not is probably irrelevent. Contact your local trading standards office and see if they can help you, they should at the least be able to inform you which steps you need to take and who to talk to.

Actually I will try this. I'm sick of poor customer service. The chaps i've spoken too have tried to be helpful.. but tell me that their hands are tied etc..

on another note.. i think i may know what the problem is.. when the device is in the case, i think it's pressing on the keyboard keys and could be causing the battery drain.. although i've locked the buttons bar the power buttons.. i dunno.. clutching at straws perhaps?
