Guest flyswat Posted May 20, 2005 Report Share Posted May 20, 2005 As an accountant, may I just clarify that the legal challenge was over the VAT treatment of the said comestible. It was held that Jaffa Cakes are in fact a cake, and therefore subject to VAT at the standard rate, which is currently 17.5%. Biscuits are consdered to be Food and therefore are subject to VAT at the zero rate. <{POST_SNAPBACK}> Not entirely accurate but the issue was VAT. Customs and Excise wanted them defined as biscuits not cakes. Although Cakes and most biscuits are both VAT zero rated, biscuits that have chocolate on are subject to VAT (this really is true), which is why customs & excise wanted them defined as biscuits in order to get VAT (typical!). McVities proved they are cakes by making a big jaffa cake thus showing it is clearly a cake not a biscuit.
