Licensing issue with VS.NET 2005 for commercial apps

It was mentioned in the Chat last night that there might be some elaboration on the licensing issue which currently prevents the use of Visual Studio.NET 2005 for developing commercial applications.

Any chance of an update on that?

I'm just about to embark on some Compact Framework development for the first time - and am keen to use VS.NET 2005 - but if I'll be prevented from releasing anything, then will obviously have to stick with 2003 for the time being.

The terms of the EULA for the beta prevent you from releasing a commercial product built using the beta version. If Everett (VS .NET 2003) is anything to go by, the should be a "Go Live" license made available closer to the Whidbey launch.
