Google got back to me.

They're following this up with Huawei.

I hope this actuly goes somewhere.. The retailer said I cant reclaim it since to update to ICS is to change software in it and therefore nulls the 14-day return warranty if youre not happy with the product, eventho it was sold to me only reason it was going to run ICS.
