This is a long story but I'll just give you the main points.

About a month ago the joystick stopped working on my E200. After failing to get anywhere with onestopphoneshop I spoke to orange who gave me the phone number of HTC. I rang them and they sent me a bag to put the phone in. I then had to ring ANC courier to arrange collection. This was monday last week. This monday just past I rang HTC to see how my E200 was doing, guess what? they hadn't received my phone. I rang ANC, they have looked everywhere but it seems the phone is lost.

Now this is where it gets sticky, ANC say that under their contract with HTC as the phone was faulty, not a new item, it isn't insured. So ANC are not going to honour any claim. I am trying to get a new phone from HTC, a nice guy called Lloyd, but he doesn't have the authority to give me a replacement. His manager who he is trying to get to replace my phone doesn't speak english so no point me trying to speak to him.

Do HTC HAVE to give me a replacement? Bear in mind that they arranged the collection at their cost, nothing to do with me.

I'm no legal expert, but I do deal with parcel carriers and missing packages on a regular basis :)

As HTC organised (and paid for) the carrier (ANC) to collect your parcel, it is up to HTC to re-imburse you if it gets lost.

It is then up to ANC and HTC to battle it out between themselves as to who is liable for the costs of the replacement, but this shouldn't involve you :lol:

I have the same problems at work

we ship on average 30K worth of bikeparts and 10k worth of telephones from our warehouses each day, and with the standard insurance the curiers offer its insured by weight, which when you send out a handlebar that weighs 100grams max and has a street value of £300+ noone is happy when the standard 'cover' provided gives you a £10 payout. so paying the extra £3 for the cover is worth it.

If HTC provided the currier, they should have had it insured for lost/damage, and if you had to pay for the courier you should have been given the option for extra cover, if you haven't got a clue what im talking about htc have to replace your phone as its there fault its gone missing
