Dilemma for me! :'(

Hi there :)

As I've been reading about those new Moto's coming out next month =p~

I have been thinking of returning my phone (SPV E200) back to Orange :oops: as they allow you to return before 14 days of having it (2 more days to go!) :lol:

I've heard about the 14 day return from a friend of mine who works for Orange Customer Service, is this true? :-k

Should I keep it? or give it back and wait for the new Moto's? :cry:

Not really but its standard practice to have a 14 day "cooling off" period in which you can return the phone if you dont like it.

Yeah, I agree. Send it back. They're talking beginning July for the MPx220, so it's theoretically less than a month.

You do have 14 days in which you can return it.

Not happy :cry:

The shop said I had no 14 days warrantee as I had a recommendation from a friend which was £50 off the bill :D

Sigh.. must love the SPV now then O:)

Is there not any other way of getting around this? :lol:

Does anyone know what the earliest time you can upgrade?

bear in mind the e200 will be alot cheaper than any of the new phones when they are launched. i would still attempt to return it, i like the look of the new phones, and thats without even asking how long orange will continue to produce updates for the e200.

Thanks for the reply, I will be sending them a email about my situation,

To be honest it was unfair of the shop of them not telling me that the warranty was gone if the recommendation was done, I think I do have abit of a chance, nevertheless, I will try my best to persuade them to allow me to return it! :D

I would have thought that you're entitled to return it if you're not happy with it. Don't know much about the statutory rights of a consumer, but surely with all the E200 bugs, you'd have a good case for returning it. Be polite but state your case firmly - usually works for me!

I've only experienced bad bluetooth :cry:

I've sent Orange several emails - all to no avail! You'd be better off phoning them. That thing about no 14 day return coz you got a recommendation has to be nonsense - and a pretty flagrant disregard for consumer rights I would have thought.

mention the sale of goods act, and that if they continue to refuse to allow you to return the phone you will contact trading standards or who ever it is nowadays

Will have to call them later as I've got revision to do for my exams :cry:

The problem is, 14 days with yesterday :cry:, which is why I went to the shop yesterday.. sigh.. I hope a have a second chance :-k

Tell 'em you went to the shop & were denied your right to a 14 day return - thats why you are now beyond the time limit. You may have to keep trying, but if you are firm, but polite & reasonable, you should still have a case with them. If the person you are speaking to does not do what you want, ask them for their name & ext. no. & then ask for a supervisor. You'll probably have to wait for a callback - but ask for a time, and then ask the CS person to read you the notes made on your account. That way, if they fail to contact you at the agreed time, that gives you more ammunition to use about how you are being mucked around by Orange, eh!?

Just remember, if you lose your rag, you've lost the argument, and you'll not get what you want. Your case is just & reasonable, so you should be able to get someone in Orange on your side to help you sort it out. Good luck - let us know what happens. :wink:

Sorry to hear about the problems. Just a note though. I noticed that someone mentioned the Sale of Goods Act. This act only applies if the goods themselves are faulty and does not include periods where a person has been given the 'privilege' of using an item and returning it within 14 days. If you are returning the product because it is faulty (this could be where the E200 bugs come in - bugs=faults) then you have the right to a full refund. The company has the right to offer you a replacement of the product or to offer you a similar but not inferior product. So if you use the 'it's faulty' line they may just give you a new E200.

I think your best bet is ring Orange and explain everything (to a supervisor if need be as was said earlier). Hopefully you will get a decent person on the phone you'll understand and do something about.

Well I had a reply back from Orange customer service via email :D

Dear Jonathan

Thank you for your mail regarding the 14 day money back guarantee and our member get member offer.

I am sorry to learn that you have decided the phone you have chosen is now not the one you want.

The terms and conditions of the Member get Member offer clearly state that customers who take part in the promotion will not be eligible to return their phone under the 14 day money back guarantee.

I can only apologise that the phone trainer did not reiterate this when you signed up for your contract.

The Motorola MPx phones have not been released on the Orange network, they are still in review.  This means that we still may not release the phone if the trials are not successful.

Regrettably, you will not be able to return your phone.

Addition to my commentss on the Sale of Goods Act. There is something you could try but I'm not sure of the legal status here. I believe that you may return a product to a company if you have been mis-sold a product - e.g. 'Yeah, it does everything, a phone, a MP3 player, TV remote, etc' & then you get it home and it is not a TV Remote (I know - silly example but I hope you know what I mean). If that has happened the person/company selling it to you has lied or exaggerated the product's features and capablities and therefore have 'mis-sold' you a product. The problem I envisage here though is that if the 14 day return policy (a privilege granted to customers from Orange) is stated as not being applicable to customers introduced by present customers, as they have said, and that this is written down in your contract then you won't have a leg to stand on. In their eyes their product - the Orange service for 12 months - is not faulty or been mis-sold, it is only the phone which you dislike and the return policy. Therefore they may either do two things if you try the bugs (=faults) route - offer you another a E200 or say that as you are unhappy with that phone on your contract you may get offered another phone (eg a Nokia 6600 or MPx 200). It's a bit of a long shot really.

I wouldn't really know what to advise. Orange's product is the network and their argument would be that it is the phone (which they will say you choose) that you don't like. All you could do is complain (politely) to Orange CS (in writing - follow up an e-mail with an written letter and tell them you are doing so) saying that you disappointed with the situation which arose from there not being clarity when you signed up. Say things like, it has affected my opinion of a company that I previously thought was of high standards and that although I am happy with their network but am unhappy with their sales staff in the retail shops. BE friendly and polite but firm and you never know, something might happen - a little of credit on your bill (that's happened to after complaining about their shop staff) or even a change of heart BUT you may just another we are very sorry, it is clearly stated in the contract, etc, etc.

Sorry to be a bit negative and if anyone else has different ideas that would be great. Good Luck whatever happens. One thing I would say is that the longer you have the E200 the more you'll like it (hopefully) and see it fuller capablities. It has bugs but it is not a lemon. And one happy thought - by the time you are ready to upgrade there should a lot more choice of smartphones around than there are now. In some respects its better to see them all released and find out the best worst and then upgrade in 9 to 12 months.

I am liking the phone more, but the more I see the Motorola, the more I dislike the SPV :cry:
