Guest ZuluWarrior Posted January 6, 2003 Report Posted January 6, 2003 I recently returned my SPV due to its faults outnumbering its good points to 90:1 in my view. and its going to be interesting to see what they have to say about this... Email to orange about their services. i just returned my pathetic excuse for a flagship phone form yourselves, the Orange SPV (i wouldve named it the VSP, Very s*** Phone). as this is supposed to be the killer phone at the moment, are paying customers like myself asking too much if we just want a phone that can do what you say it can do???? it clearly cannot be used to its ability, and i know that i am not the only anrgy :x customer who has returned this phone. Now i wonder, the so called 'unlimited' GPRS (limit of 3000mb so i was told by the link) going to be really unlimited?? i dont think so, apparently from other spv users, theres a limit of 10MB per day, and 50MB per month. hardly unlimited if you ask me. also there is no way of checking data transfers, and i was told that orange will not contact customers when they have reached or exceeded this limit. a great way for orange to rip-off its customers again! now after speaking to a friend who works for orange, he told me that orange knew about the software and hardware problems this phone had, but it was pushed onto the market no no where near as much testing as any other phone they sell (look at SE p800, been in testing for months and months, and probably will not see a release on orange until march or later). Does orange know about this? The Sale of Goods Act 1979 (as amended) The mobile phone should be of a satisfactory quality, fit for its purpose and as described. When deciding whether the mobile phone is of a satisfactory quality its appearance, finish, durability, safety and freedom from even minor defects can all be taken into account. If the mobile phone is faulty, you have a legal claim against the retailer of the phone and they should help you to resolve any problems. Well not by the looks of things, and what about... The Unfair Contract Terms Act 1977 and The Unfair Terms in Consumer Contracts Regulations 1999 These laws allow you to challenge terms that may be unfair or unreasonable to you as a consumer. The standard terms and conditions used by the retailer should be written in clear language. It is illegal to have a contract term that attempts to restrict a consumer's rights. In some cases your local Trading Standards Department may be able to take action to prevent a company from using unfair terms in their contracts. And what about this one.... The Trade Descriptions Act 1968 As well as The Sale of Goods Act 1979 (as amended), which says that the computer should be as described, the criminal law says that any description made should be truthful and accurate. If this is not the case then your local Trading Standards Department may be interested in the information. Im sure Watchdog, Trading Standards, and Oftel would be very interested in this, that is unless they already know. Thank you! :D
Guest Emad Posted January 6, 2003 Report Posted January 6, 2003 If you are charged by Orange for excess GPRS usage after your first month and it is not stated in your service contract that there is a 'fair usage' limit to the package, then feel free to sue their butts off. There are 'unlimited' packages all over the place - see sms/calls/mms, but if you look in the contract (which you are expected to read), there's usually this proviso. Aside from that, the SPV lives up to its billing in terms of hardware - excellent construction/durability/finish etc. Much better build that a lot of the mobile phones I've used and light years ahead in terms of features. The only thing letting it down is software - if this does not match up to the claims and Orange refuse to rectify the situation, then you are entitled to take action. I agree its a buggy beastie (although mine has been fine - I just use the bits that work and still have more functionality than most phones except the bricks), I remember when the T68 came out. That was a bastard to use back then. Also, I tried out the Nokia 7210 and Sagem my-X5, the phones that were competing with the SPV for my pocket - the 7210 kept on screwing up (odd for a Nokia) and the my-X5 couldn't even hold a call. Pth..

Guest Emad Posted January 7, 2003 Report Posted January 7, 2003 I had bad experiences with the T68 when it first came out and my friends with T68i's aren't too thrilled with them.. Having peered around the forum, ZuluWarrior's point seems to be v valid with consideration to what's happening to Paul at the mo - getting charged £8 a month for every meg above 10?? Bah. They're gonna get a lot of returned SPVs if thats the case.

Guest Gadgetman Posted January 7, 2003 Report Posted January 7, 2003 Just had my first bill, 26Mb on GPRS but NO extra charge, just the basic 6 quid, so Orange are sticking to the deal as far as I am concerned. As for monitoring usage, the ALL-locations GPRS Traffic Counter software trial works so well, I've actually bought the full version. All phones I've bought over the last few years have had something wrong with then (especially the Nokia 7110, that was fun!) but the SPV is the first that can be fixed via wireless updates AFAIK. It's not perfect, but it's a lot better than anthing else out at the moment, especially when you take into account the media player and use of SD cards.

Thats 3 times when I've been into the Orange shop to ask to have a go with the phone: 1st time) an hour after they got the first SPV in store, sales person hadn't even used it. I showed him lots of the features, and crashed the phone 3 times. Couldn't figure out how to get the phone to use the camera, and using the internet was not going to happen. 2nd time) went in to see how the internet worked with GPRS. asked to see the phone, was given the phone where I went to ie and tried to load Google. After waiting 4 minutes I gave up, and asked why it wasn't working. Phone then crashed, and after rebooting we tried again. After using the sales person's own gprs enabled sim and not having any luck he helpfully suggested "well perhaps someone dropped the SPV on the floor, which is why it isn't connecting to the internet" 3rd time) Just before Christmas I went in to another Orange shop. Slightly better. Got onto the internet, and managed to see a couple of pages before it crashed. Only crashed the once though, and I even got to die a few times on Rebound! Now I know that its a first version phone, but I can honestly say that I've never used a phone that has crashed as many times as the SPV has - and that was when the sales people were trying to sell me the phone! I do think Zulu's email is a bit harsh in tone though. If you actually used the phone in the shop for any amout of time, and tested as many features as you could, then I'm sure you would have realised that you wouldn't buy a phone for its rock solid performance... This is a phone for tech-heads, early adopters, and posers. If your not one of these, then you'll have taken it back by now, and bought a Nokia! If it wasn't for the P800, and the fact that the more I try and find justifications for replacing my 3 year old 7110, the more reliable and cool it seems to get... then I'd have bought the SPV, as I'm an as early an adopter as I can be on my student loan/overdraft - and I realise that this won't always mean I have the most stable hardware! -funkyberry-
Guest Monolithix [MVP] Posted January 7, 2003 Report Posted January 7, 2003 i've had my spv since a few days before xmas, and it hasnt "crashed" once. slowed down admittedly, but always righted itself. i think some people are either too impatient or have some of the "dodgy" first batch that came out back in november. i'm _very_ pleased with mine. as for the p800, i really really want that phone heh, touchscreen is very useful, however wont it be retailing at something like 3x the price of the spv? (assuming you got it for £99.99)

Guest Rob.P Posted January 7, 2003 Report Posted January 7, 2003 Can't believe the amount of trouble people have been having with their phones, I got one of the first batch on the day of release, mine's crashed that many times that I only need one hand to count on. My Nokia crashed as soon as you disconnected it from the PC. Prehaps some people are trying to use their phone like a Laptop, which it blantantly isn't. As for those of you that expect Orange to admit liability and fix all issues straight away... WAKE UP this is modern day society, name one company that treats you like you expect to be treated. Customer Services as it was known is not like that anymore, if you don't have the patience, then it ain't knowone's fault but your own. We live in a society of blame and liabilty (sad I know), everyone wants to blame everyone else and everyone else doesn't want to admit liability. For those of you considering sueing, don't bother you'll only ruin it for the rest us because of you own selfish needs. (You can tell I'm having a good day at work :D )

Guest DJHope Posted January 7, 2003 Report Posted January 7, 2003 "here we go again" Weird but my fone last crashed on Christmas eve, when i got like a million "happy christmas" texts! It hasnt crashed since, the other day i was in the pub showing it off played a movie (star wars) a game and surfed the internet (for some reason my childish mates wanted to see porn) no crashing. Im am now offically in love with my fone (not because of the porn). Thing is id definatelly ask for a replacement first. Also not being funny (i could be wrong here) but the "demostartion" model in the shop is likely to be a pre-pre-release fone (since we got the pre-release fone). Dont get me wrong the SPV isnt perfect but i challenge you to find a fone that can play moves and music.

Thats it, and ive surfed loads on it, watched countless south park episodes on the train, mp3's, taken quite a few piccies with the camera, and one crash. I dunno whats wrong with these other fones ppl have that crash all the time.
