Guest Rolandrat Posted January 7, 2003 Report Posted January 7, 2003 If a phone seller's adverts said "Unlimited web browsing, email and access to a great range of information and entertainment services (terms and conditions apply). It costs £6 per month on top of your chosen service plan, but we are offering it to you FREE for 6 months on Connection to any Talk Tariff" When advertising a SPV what would you say that means? And yes I know what I think it means, I would like your thoughts.
Guest spacemonkey Posted January 7, 2003 Report Posted January 7, 2003 What it means is that they want to sell you a service that is actualyl not brilliant and they think they can get away with lieing about what that service is if they put the words "(terms and conditions apply)." in the advertisement. I think they'll find that they are wrong. Terms and Conditions apply could be used in the case where they wanted to restrict who exactly got the package but the terms and conditions can't outright refute any of the claims in the add. So a T&C would seem to me to be invalid if it said any of the following: the service is not unlimited the service could cost some amount of money other than £6 or in this case free for 6 months the service is only availble on a limited range of Talk Tariffs The T&Cs could legitimately include things such as this offer expires on xx/xx/xxxx or offer is only available on a new connection or offer is only available to customers with handset x,y or z
