Well it was a litte complicated but here goes, first of all i bought my e200 because it was all singing all dancing, and when i purchased it the main features i was interested where bluetooth.

As soon as i purchased a jabra 250 and found there was an issue, which was pinned on this board i contacted orange on 150

1 hr on hold for orange to say there was not an issue and if i can make and receive calls there part of the deal was covered in fact i nearly fell of my chair when they said they didnt even support bluetooth but eventually they gave me HTC europes number.

next I called HTC they confirmed the issue and they explained they are only responsible for warranties and i should go back to orange.

so i called orange back up to be told same as before.

I then called the place where i bought it from, explained the situation and also said that although i was very happy with the retailer orange had put me in such a situation that they where the only ppl who i could really do anything with and with that in mind i would have to ask for a new phone of a different model under the sale and supply of goods act 1994

there are 3 main point under that law in which i am covered

• Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).

• Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.

• It is the seller, not the manufacturer, who is responsible if goods do not conform to contract.

all these points have been taken from DTI website.

now with this in mind and the handset unfit for the purpose i bought it for my retailer contacted orange who promptly replaced the handset Free of charge with a new C500

and before you guys say anything it is not an upgrade, i didnt have pay anything and i dont have to sign a new contract.

so to all you guys who are peeved off that the bluetooth headsets dont work, dont just sit there contact your retailers or orange if it doesnt live up to you expectations then it falls under the sales of goods act and you are entitled to a new phone or termination of contract.
