While I was in the T-mobile store the sales woman said that upgrading would mean I would stay with the same price plan for the next 12 months...After about 2 weeks I was checking my balance and found out that I was on a different plan (with less minutes and no texts included!!!)...Called them up and they said that the price plan I was on previously was a promotional one for the first 12 months and doesn't apply to the further 12....WHY didn't they tell me that!!! I am so angry!!! I would not have renewed my contract if I knew that this was the case!! What would u guys do if u were in my shoes?? It's really annoying... Thanks in advance....

I hate them for this!!!! :evil: <{POST_SNAPBACK}> Under Consumer law they have breached the verbal contract that was made to you by the girl in the shop. I subscibe to Which? Magazine and there have been a number of cases (Not with T Mobile I hasten to add) where the consumer has won. My suggestion would be contact Citizens Advice for legal advice then hit the Shop and the company with a letter stating the advice. Be prepared to go as far as small claims court..

He was contacted and advised to change plans as it would save money and add texts and minutes. When the bills came through it was actually more and the texts and minutes were not as diecribed. He contacted them and cancelled his contract in the basis of "misleading information" Best thing to do is contact them, explain it to them and either get them to put you on the plan you thought you were on, and if still no joy...cancell it. Another option is to contact OFTEL (i think they govern mobiles as well as landlines?) and get them involved. Don't back down though, this is what they expect you to do and will try every trick in the book to make it difficult. The only problem you have with the sales girl is that it was verbal, unless you have it on a receipt or statement at the time of purchase, and at the end of the day it could be your word against hers. I called them up again to try and get my minutes back, but customer service were not very helpful and tried to make it worse!! I was fuming over the phone and decided to cancel my contract...The guy said that it would cost me around £200 to cancel :shock: ! I said I am not paying 1pence as I was tricked!! Anyway he put me thru to cancellation department and they asked me why I want to cancel and explained to them what happened...So they said if we put back ur minutes will u stay with us, I said yes...So my minutes and texts were put back...Problem solved!! I think next time I will try to cancel my contract before upgrading to get a better deal! Lesson learnt! Thanks for all the support guys! Appreciated! Mohamed
Guest Chaser81 Posted June 8, 2005 Report Posted June 8, 2005 T-Mobile have a vehement no returns policy on upgrades. With every other network (except Orange), you have 14 days to return the upgrade and cancel it, but with T-Mobile and Orange, you do not get this on upgrades. Once its done, thats it for 12 months (or however long you signed up for). Sorry mate, but I think your stuffed.

Guest Chaser81 Posted June 10, 2005 Report Posted June 10, 2005 (edited) True, not disputing that, but the original poster may find it useful to know what T-Mobile's policy is if he tries to go down the route of cancelling his upgrade, so that he knows what he is up against, thats why I posted it. I posted something I thought it might be important for the original poster to know. This topic seems to have gone a little astray with people having a pop at me for it, so how about we ignore whether or not you (and by "you" I mean everyone in general, not having a go at anyone in particular before you start on me) think its helpful and continue to provide advice on the orginal poster's problem instead, eh? ;) EDIT: Incidentally, with reference to mmbecks prob, I think he is entirely entitled to have T-Mobile do something about it, but whether they actually will or not is another matter (as the mistake was on the part of the salesperson, not them). Because of their upgrade policy, they will refuse to cancel the upgrade, especially because, as I mentioned, the error is not theirs, but the shops. Therefore, I think your recourse mmbecks is through the shop's manager or customer service department. See if the company you got the upgrade through will do anything. I just wanted my minutes back , and since they gave them back then there is no problem at all! I upgraded my contract knowing that I will stay on the same plan, but they changed it without telling me. But now it's fine... cheers
