Dodgy C500 insurance replacement

Hi guys

I was nearing the end of my contract and intended to sell my c500, however the dust was building up so I phoned orange in the 2nd to last month of my contract (about 2 -3 weeks ago) They arranged an insurance replacement at the cost of £15 which came a few days later (i had been promised it the next day but it didnt turn up!)

Anyway I had a c550 by this point so was using that, then when the c500 came i didnt think to much about it. I did switch it on but didnt use it.

Now that im getting round to selling it I was going to sim unlock it, but when i powered it up with the sim card and connected it to the PC it went kind of crazy. Id doesnt charge, and of course ive tried all the hard resets etc.

The problem I have is that a week or so after getting the c500 replaced i called orange and got an upgrade to the m500, i also cancelled my insurance and changed tarrifs.

So now that I realise Ive been sent a dodgy refurb is there anyway orange will replace it or will they keep insisting that the m500 is the phone on my account thus the c500 isnt there responsibility.

My main point is that its never worked correctly since it was dispatched, and although i have had an upgrade, orange still had to send me a working phone, which they didnt do.

Any thoughts? In particular from those who work with orange who know there system

I really doubt you've got a snowball's chance in hell of getting them to fix it. Partly due to now being out of contract. Partly due to being no lonfger insured and mainly because you've waited a couple of weeks. You can ask, but they're most likely to try and claim that it was OK when they sent it and you've b0rked it since. They are unlikely to care since it is out of contract now.

I had a similar thing recently, and you've got little chance judging from my experience.

I'm a premier customer, I had a silver C500 swopped out in March, used it for a bit, then got an MPX220 offline and started using that. In the meantime, orange also agreed to replace a 2 yr old MPX200 that had crashed after entering an official orange subsidy unlock code that cust services had given me the end of last year. Great I thought, a nice new shiny phone to flog :-)

Anyway, I upgraded to a C550, it had a faulty key so tried the next day to send it back, after 3 weeks got a returns bag and away it went. So I pulled the silver C500 out of the drawer and the phone gets to the splash screen and no longer boots...

I called cust. services to arrange replacement, explained the c550 upgrade on my account had actually gone back, they said they'd have to refer to the insurers. Over a week later after a bit of chasing they came back with...

The C500 wasn't on my account! I only had an MPX200 ( which was a goodwill swop for a p800 from a retailer not from orange anyway!) according to them so they wouldn't swop out a C500 as they had no record 'on their system' of me having it and no record of the imei being used on my account, so no swop!

I originally had the c500 over a year ago so my original invoice is no good with HTC for maufacturers warranty, but I still have the swopout receipt from the exchange - does anyone know if this counts as re-invoicing under UK consumer law or should I just see what HTC will do as goodwill - the C500 still says it's under warranty on their website.

Obviously I was pretty annoyed with Orange cust. services but I did end up getting a good deal on an upgrade, getting both an M2000 and an M500 for line rental on 2 lines of about £60 total with 1000 X-net minutes to share. It's probably my 80 meg a month data usage that swung it.....

Not on a premier plan anymore though I have added insurance to them, now I know the score I'll handle them better in future - I'm selling my older M2000 and keeping the new one as that's the one they'll have listed - although I'd likely get more for a new sealed box if I needed to claim it'd only cause trouble.

Can anyone confirm? I pay £5.00 a month for Orange insurance, does this cover my c550 for a new replacement or just a refurb.?

It will only cover a refirb after the 28 days you have had the phone if you have sent the phone back twice with the same fault they will give you what we call a DMR ( Diffrent Model Replacement ) If your not happy. but this will not be given automaticly only if you ask for it
