Guest J273 Posted December 20, 2005 Report Posted December 20, 2005 Hi guys im buying a car from a guy in Edinbourgh and hes agreed to bring the car down to me in burton on trent as the new car he's wanting is close to where i live. What i want to know is ,say whilst he was on his way down to me from edinbourgh and he got caught speeding ,who would the points go to? .as he would be transferring the car into my name on the same day that he bought the car down,would they be put on my licence or his ? as when you fill the log book theres only a date of transfer so it could of been me driving even though it was him. What would happen im asking because ive been driving just under 2 yrs and cant afford to get the points at all,but was interested to know. Thanks
Guest fluffcat1 Posted December 20, 2005 Report Posted December 20, 2005 The NIP ( notice of intended prosecution ) has to come through to the registered keeper within 14 days and in my experience, especially over new year, your change of ownership will not be processed that fast so the NIP would go to the current owner. Obviously he *could* try to claim you were driving but based on the direction of travel and time frame you could easily prove he was travelling to you when caught if it happened.... Richard

I bought a car on the day you posted, I'm not expecting to see the new V5 doc until well after new year. (Ah bliss, finally don't have to drive my dying Rover 214, bless it :) )

I understand you may not want to display his name here but send me a PM obviously he is tryin to get you on a bad record the way things appear to be going and doing things unprofessionally instead of using his mind!

Guest Confused Stu Posted January 2, 2006 Report Posted January 2, 2006 To answer the original question - it doesn't matter whose name the car was registered in, whoever is driving gets the points. If you're driving your mate's car and get clocked, the letter goes to the registered keeper (your mate in this hypothetical case) and he has to say who was driving. So even if you did get a letter a few weeks after getting the car, you just put down that it was Mr Previous Owner who was driving, what his address is, and he then has to take it from there. Don't worry - speeding fines and points are always on the individual, they only use the car registration to trace the individual. Hope that sets your mind at rest. ;) What car did you get, by the way?
