What would you do ?

I just got my C500 on Friday past .It's brand new from a seller on E-Bay .Over the week before it arrived I had downloaded loads of software to update (ROM) , de-cert and sim unlock .On Friday night I got into the phone to check the ROM version and did a version update . Later that night I copied the required .cab file to de-cert it . On doing so I noticed a file entitled volcano_*rse.mpg4 .At first I presumed it was a screen picture or a windows media file and never thought anything of it. On Saturday I unlocked the phone and it was ready for use . I checked out the features of the C500 and tried out the PV player [media player] and to my astonishment it's a porn file . It's 1m 33 s long and 400 kb . Right I'm no prude and have seen worse BUT not on my phone . So the seller has put or left a file on the 16mb mini sd card either accidently or for a laugh . I was going to delete it , but I thought , hold on , this phone could have been for the wife or one of the kids and to make matters worse I work at a school ,10 to 13 year olds , I know what would have happened it this had been seen by one of the staff .So, question , what should I do ? and what would you do faced in the same circumstances .Delete it and forget obout it ? or complain to the seller ? . The file is still on the phone , as evidence , So , it wont be going to school with me in the morning . I'd be interested in your reply on the matter .

I'd complain to the seller and contact ebay, porn is illegal. Ebay may take this into their own hands and you might get your money back or sumin can you find out the date that it was put on there if so you have even more proof.

cheers mini_man for your reply , thing is I wouldn't to part with the phone and hand it back,it's new and it's nice , It's just I would never have expected to find this sort of thing on a new phone , obviously the guy must have fitted a second hand sd card for the sale , I've ordered a 512mb in any case . I would hate to think he was putting these files on phones for other sellers ,maybe even children. I suppose he must be warned .If I notify E-Bay , bang goes his business and he wont be very happy.

You may as well delete it in my opinion because porn isn't actually illegal. Your post implies that the clip contains nothing that might interest the police and I doubt eBay themselves would take an interest.

You could complain to the seller but to what end ? An apology ? "Yeah whatever" ?

You'd be better employed explaining to your 10-13 year-olds why wearing Playboy bunny merchandise is wrong, with all due respect.

Oh, and ignore all requests from MoDaCo members to post it up here ! :)

I say get over it. Porn in not illegal, although that depends on the nature of the file in question.

It may have been a genuine mistake, it may not, only one person truly knows. No harm was done, forget it.

yeh suppose your rite disco stu and elgato, i wouldnt really know if it were illegal or not :D

complain to the seller and advise him.

@Disco Stu , this is the sort of attitude I hear quite a lot now ,turn a blind eye , it's only porn or it's only bad language , that's why it's getting quite the norm . No offence meant . I'll just leave it on and show my mate's down at the pub :-)

i would just get rid of it before any body sees it and forget it

Yeah no big deal , I've just e-mailed the seller and advised him what was on the card. I'll watch the video afew times ........send it to my PC .......convert to DVD ........put it on disk ..........then delete it :-)

I bought a second hand phone for my dad, it had some kinky photos taken with the built in camera still in its memory, thing is I didnt find these my dad did :-s

Dont think he minded :-)

I copied the photos to my computer and emailed them to the seller asking if they had any interest to him, he replied a bit sheepishly asking me to delete them :-)

Unless it was illegal porn I would just delete and forget about it--no harm done.

I e-mailed the seller last night and asked him to be more carefull with what he leaves on the sd cards for future buyers, but he never replied .I was'nt bothered really as I did get a brand new phone off him . The vid content although hard core wasn't more so than I pick up with my Sat system, So ,I'll just wipe the card and forget about it.

If the phone is brand new, why is there non standard content on the included card?

Exactly , the phone was definetly brand new ,only the 16mb mini SD card wasn't .He may of been messing around and put the wrong card back in . I dont know ,but I did notice , the box was all ripped , the instruction guide had a different IMEI wrote in the box on page 10 to what was on the phone, the IMEI number on the box didn't match the book or the phone .There's some iregularity somewhere , remember I did buy it off E-bay and it was still a bargain , so I'm not going to complain.

This sounds extremely dodgy, and as soon as IMEI numbers do not match up warning bells start to ring. There have been people trying to buy "boxes" here before, (the posts get automatically removed) presumably to sell questionable phones "as new"

If I was you I would double check the phone has not been blocked

or in the process of doing by phoning Orange.

Have you checked the past history of the seller?

It would seem more likely to me that the seller has received a warranty / orange care replacement handset and is selling this new handset with his old box and accessories. Easy enough to check if it has been barred and it's not something that sits in the system as being 'in the process of' - it happens immediatley.

Yes ,I know these things go through your mind when buying phones etc, has the phone been stolen etc etc. I suppose its a gamble. But, Its working fine on T-mobile , so , no problems YET. If it was a dodgy sale , it's not as if I knew it was stolen or I was acepting stolen goods .I have all invoices and reciepts from E-bay.I think the phone has just been an upgrade the chap has sold. I Hope !
