Guest fraser Posted May 2, 2006 Report Posted May 2, 2006 Em, that's Germany. They have their own legal system. And Modaco is UK based, right? Cross-euro legal precidents aren't quite here yet... Also, this specific case mentions "business operation". Is Modaco "for-profit", i.e. a registered business? If not, you're likely safe on these grounds, though the article does point out that this is unclear in this case. Finally, it's under appeal, which should be upheld. Are we going to go after BT or NTL for all the usenet nastieness out there? I think not. This law won't last very long...it essentially kills all discussion on the internet in Germany. That fact that it's not clear won't help it stay; unclear laws are bad laws. (I am not a lawyer, but I do follow these kinds of things a little)

Guest fraser Posted May 4, 2006 Report Posted May 4, 2006 Sorry mono, didn't mean to come off quite as I may have done. It's just these stupid laws annoy me. Recently they've been scareing me! Paul might still be at risk tho. ;) It seems the court system really isn't all that in-touch with new technology. Some of the new data-retention laws are going to hammer ISPs; they'll need dedicated data werehousing to comply. The internet is genuinely at risk now from stupid legislation killing it.
