want to change vario

i got a mda vario from tmobile last week, very please with it does everything i need. didnt no they had a new one coming out soon. if i was to phone up tmobile say that the phone is faulty do you think they will let me have a vario 2 instead when it comes out. ill say that it crashes and want to try the newer version. hope they let me lol

I would bother spinning them a line. Just use your consumer rights and return it saying that it didn't meet your expectations or something. Say you thought you were getting the vario ii and made a mistake. Anything. If you've had the device for less than a week I don't see the problem.

Did you get it in-store or from internet/telesales.

Legally this is very different, as under the latter you have rights under the distance selling lesiglation, but only for 7 (SEVEN) days in which you have to make WRITTEN notice. Call them up today, and ask them what email address to use.

You are obviously still liable for any line rental/call charges from the last week.

If you got it in-store, I would sit back, relax, and wait for a Vario III in 12/18 months time :D

If you say it crashes then they'll wonder why you don't just want it replaced with another working Vario.

You could ask for the Vario II as I'm sure that they'd prefer to replace than refund. Expect to part with some extra dosh for it over the Vario though.

References to crashes etc will not work.

Telling them that you honestly thought the Vario was the new model and didn't realise that they had named it Vario 2 instead of just the "new Vario" is your best bet.

You got it over the web less than 7 days ago? You are well within your rights to send it back under distance selling regulations. You don't need an excuse, just call them up, tell them you don't want it. Easy!

If they want to play silly like that then just say you want to return it so that you can go with another network who will offer you an equivalent device to a Vario II for around
