T-Mobile faulty Vario 2

Hi

Sent my vario 2 in for repair for various issues including screen alignment, I got it back 2 days ago and still having problems. Now when im on the phone there is a loud clicking constantly, the keypad stops working intermittently and the phone doesnt always pick up an incoming call when i hit the answer button.

I went into shop today because i do not want the vario 2 anymore and its associated problems. I asked for a different model handset or to get my contract terminated. They said that they can only send it for repair again and refused to give another handset or terminate contract.

Can anyone advise where i stand on this issue by law. I have lost all faith in the vario 2 and really do not want to to have it repaired again or get a new replacement. I was also told i could contact the manufacturer as the warranty is with them and not t-mobile. I thought that the warranty is with the place you purchase the item regardless of manufacturer.

Any advice is greatly appreciated as i cannot continue with this phone.

The sale and supply of consumer goods regulations 2002, clearly states that the buyer can required the seller to repair or replace the faulty goods within the first six months after purchase; but we have service providers who interpret things as they wish without recourse to any legal rights the customer has.

BTW, it's the vendor not the manufacturer that has to sort out issues within the first six months. Google the acts and then quote it to them.

They have offered to repair again but i do not wish a repair or a new replacement. I just have no faith in the vario 2 now so i would rather another make of phone altogether or to terminate my contract with no obligations which they say they cannot do. Surely legally i should be able to refuse to have a repair or a replacement when there is so many problems with these devices.

Just a heads up on t mobiles rules and regs, well wat they were bout 8 months ago, is if something is sent for repair 3 times, they swap it over for a brand new phone, whether they would do that for a different model i dont know, all i know is when my d500 broke they swapped it for a d600 as werent any d500s, straight there and then in store. Maybe might be worth ringing up customer support and say you're not happy and thinking of getting lawyer involved, if they work anything like the company i work for they'll panic and obey you're every wish! Makes sales staff in our company so annoyed, but they do it anyway

As far as I'm aware all T-mobile have to do is replace or repair the Vario II which they seem happy to do. I suspect if you spoke to the store manager they'd probably swap it for an N70 or similar as a gesture of goodwill however if you really want a more basic phone you do have another option.

Why not get the Vario Ii replaced or repaired, check it works, then bearing in mind that it's got such a high resale value, sell it on ebay, use the money to buy something like a K800 or whatever spending the remainder on beers.

You do indeed have a legal right to cancel the contract due to issues with the product. Read through the act is my advice.

Got a call from T-Mobile customer relations today after i put in a complaint on their website yesterday. They are now going to allow me to return the Vario and choose another phone. Without problems the vario is a good bit of kit but i just dont have the patience to keep sending it back for repair.
