Free upgrade and 18 month contract

The Carphone Warehouse rang me up on Friday 2nd March to say that my 12 month contract was expiring and offered me a free upgrade.

I got a new Nokia (grrrrr) phone and 10% off my usual tariff. It was explained that I had a 7 day colling off period if I didnt like the phone.

I got the N73 on Monday and found the buttons to be too small, clunky interface and noticed that there are more upto date Nokia's out there.

I now feel a bit ripped off that I have got 'last year's' phone, a longer 18 month contract and a phone that I don't like or can operate properly.

I rang the Carphone Warehouse yesterday (6th March) to try and tell them about my gripes but noone seemed interested - I got passed around ten different departments before being told that someone would call me back - noone ever did!

I rang again today and got through to someone with at least half a brain - who told me to keep this Nokia phone and sell it on Ebay and carry on using my trusty C600. He said I've agreed to another 18 month contract and am stuck with it!

What can I do here? Am I really tied into an 18 month contract with a phone I don't really like? I havent signed anything and was led to beleive that I had a 7 day cooling off period.

Any ideas guys?

Distance selling laws may be valid as you had a cold call. Inform then by phone and in writing that you are cancelling the contract and they can arrange collection the Nokia from you.

As long as you give written confirmation (recorded mail so they can not say they did not receive it) you should not have a problem and don't forget to mention distance selling regulations and you were informed about this at the time of the cold call.

To return a phone you need a 'Return Authorisation Code' for them to accept a returned phone!

I have now been phoning for THREE days to try and acquire such a code but noone is willing to give me one!

It is now day seven of my '7 day piece of mind guarantee' and I am still no further forward. Once again their customer services have promised that someone will call me back within 24 hours (as they have promised for the last three days) but still noone has rung.

Their customer services totally stink and I am now totally decided that I will never use Carphone Warehosue again. Not only do their customer servies stink but also their prices and tariffs!

Right whats on offer in the Modaco shop......

Visit the Carphone Warehosue shop before the closing time and refuse to leave till the issue is sorted out.

Happened to someone I know and it worked.

Ive just waited/wasted for the manager to ring me back in the last 7 hours but no call has appeared! What a surprise!

Ive just given them another call this evening to see why noone has called and they couldnt tell me why!

Ive just had a major whigne about their CS to this woman who said that she was unable to do anything and that I needed to speak directly to the person who sold me the phone. She game me his number but on calling it the number was not recognised!

Im gonna give them one more chance tomorrow and then its down the shop and causing mayhem!

Im getting a tad annoyed here with all this!

Just rang them again today (whilst the rugby was on - so got through instantly!)

And was given a number to contact directly concerning me getting my contract finished - but I got the woman to ring it for me who eventually admitted that the number was missing a digit and that she didnt have it there!

According to their system they have tried to contact me but as my sim card in my C600 has been deactivated I am unable to make or recieve calls via my mobile so I have left my home phone number there for someone to call me.

CarphoneWarehouse seem intent on not letting me cancel the contract so I am now returning the phone and the contract with a letter detailing my request to see if they will act on this as nothing else seems to be getting any action out of them!

Make sure that you send it special delivery or else there could be problems. If I were you I would,as advised, take it bake to a store and make a right fuss.
