However what has come to light is that I've had messenger for free for almost 18 months when I clearly shouldn't have on a basic WnW tariff. What decides whether I get this ? Is it a setting on my device or something on my account ? The reason for asking this is that the best deal I can get is from T-Mobile. However this would only be as a new customer after jumping my existing number via a PAYG SIM to keep it. Yet if in doing this I lose MSN and have to upgrade to include it, its no longer the beast deal.

However, You'll find plenty of posts on here about T-Mob customers who use WLM on Web n Walk basic (myself included). I think it's a common sense approach by T-Mob, as long as you're not hammering your WLM usage every day, with only occasional usage, I don't think they really care - I don't recall reading any posts from T-Mob customers who have been warned about using it. If you mean that the new device doesn't have WLM installed on it (not sure if T-Mob are removing it from their devices like Orange do) then that's no problem. Just do a Google search for "Windows Live Messenger Pocket PC" and you'll find it available for download. Can't post a direct link to it as it's against the forum rules. :D

While I've not heard of people being charged to use it, I have heard of many on our tariff who are unable to use it. What I'm trying to get to the bottom of is whether they are prevented from using it by some un-accessible setting on their device or whether access to this feature is controlled by T-Mobile at their end. It all seems very inconsistant and I'm trying to minimise the risk of loosing it as I use it quite a bit.

To my knowledge, most operators say that all IM services (not just windows live) are not permitted under fair usage of their unlimited packages. Nothing to say that you can't use them out side the packages and since you can't control this what do they expect. I don't believe that they 'prevent' anybody using it. It's certainly not a device setting - they can't stop you from using it when your connected to wifi. Did t-mob specifically say to you that you could use it on your old tariff - I suspect not, so what has changed? It's the same situation when using your device as a modem for a laptop - but everyone does it. At the end of the day they are just covering there backs in case anybody start abusing their network.
