Beware Car Phone Warehouse** Thanks for everything

This is just a heads up buyer beware of Car Phone Warehouse T&C's. If you plan on buying anything from CPW be aware of their returns policy. There are none, my wife went to our local branch asked the manager if the LG renoir was win mob 6.1 & though the guy never answered that question " as she had quite a few" she did explain to him she had a HTC phone before & she needed a phone with GPS to use tom tom & her other windows apps. After a lengthy discussion she left the shop with a brand new T-mobile contract & LG KC910 in tow not realizing her most important question wasn't answered. On reaching home she handed the device over to me to put her apps on & as soon as i saw it i asked her what she wanted me to do with it as it's not a Windows mobile device. Then the penny dropped the he never answered her. We immediately called up the store manager & her remembered her, he also remembered that he never answered her question which he was sorry for as it's is now too late because he can't take the phone back because it's t-mobile & t-mobile won't allow her to change or cancel the contract, (but as it's her e& he knows her he''l see what he could do". In addition mr manager also sold her a 2gb memory card ( which could not be used as the phone comes with an 8gb card), a contract without internet access ( bear in ming the phone has google maps" & a car charger to use her phone in the car with tom tom.

Days later after lengthy conversations with cpw customer services, being offered a cheque to cover the net access for 18 months, refund on the charger & mem card, offering 50% towards the cost of handset only to but a windows mobile handset, & being told it was an impossible task to just change the lg because of t-mobiles policies, I told her to call t-mobile & guess what.

T-mobile customer services got onto CPW to get them to correct their mistake & either give her a phone that suits her requirements or release her from the contract they still won't budge. So the very nice lady at t-mobile called us back & canceled the contract & told her she can keep the phone. It's now on e-bay.

During this problem I did some googling & found out CPW returns policy stinks. They are happy to take your money but even when they make a mistake they would prefer to pay you cash rather than refunding the customer.

Moral of this story is don't shop there.

Hope I don't get into trouble for posting this but if needed I can prove that this incident occurred.

CPW are notorious for this sort of behaviour, whether it be deliberate, or just poor staff training.

The bottom line, in this instance, is that CPW don't have a legal leg to stand on. If it happens to anyone else, contact your local Trading Standards and register a complaint under the mis-selling regulations. You could also take out a small claims court claim.

Luckily your situation was resolved by a helpful operator, but a lot of people need to be more aware of their rights in these circumstances.

Best option is to buy from tinternet or over phone and then at least you have Distance Selling Regulations to fall back upon. Which includes cooling off periods and contract termination etc.

Correct That's how i got my Omnia problems with Orange resolved & how I got my Touch HD. Mind you if i didn't know my rights, the supervisor I spoke to at orange would have gotten away with fobbing me off with a Touch diamond, but in that case i got onto Citizens Advise, who told me what legislation to put in my letter, how to word it & 3 days later got a call from Orange executive office apologizing for my inconvenience & resolving my omnia problem by replacing it with the touch HD.

Mind you she did try saying " oh thats not how we do things at here at Orange" to which i immediately replied " I know, that why we as consumer have rights & a legislation to protect us"B)
