after r3.1 update apps missing from market

hi,

after updating to r3.1 - MoDaCo Custom ROM I noticed that some apps (e.g. google earth, google goggles) are not visible in the android market. even if I go straight to the website, it doesn't let me install them. anyone had this issue before?

I'm also seeing this, could be due to the phone being rooted.. or reporting itself incorrectly. The market is pretty touchy.

Just for clarification, I'm using the R3 firmware from the kitchen, not R3.1 but noticed it after flashing from stock firmware.
