O2 store + CPW cooling off period

I really want a Streak, but I'm worried about reception at my place of work, and all these 'connection dropouts' that everyone seems to be taking about.

What 'cooling off period' does O2 and CPW have?

Is it 14 days? Can I just take the phone back and get all my money refunded?

Any advice would be greatly appreciated :lol:

Yep, 14 days. You will get charged for the data/minutes you used though.

Well I have had my Streak for 18 days and I love it. However I am walking into the O2 Store tomorrow and demanding a refund as I have found o2 data reception to be appalling.

o2's cooling off period is 14 days but CPW dont have one unless it is faulty so be very careful. A friend of mine recently had the same problem but with a Blackberry. She changed her mind within 6 hours but CPW wouldn't budge.

The 14day return and exchange policy at CPW only applies to new connections and not upgrades so if she did an upgrade on her existing contract she wouldn't

have been able to return it.

If it was on any other network then there is no 14 return and exchange full stop.

Something i have to deal with everyday :lol:

Many thanks guys, I'm looking forward very much to getting my Streak tomorrow.

So basically CPW do the same 14 day cooling off period as O2, but only because its and O2 new contract.

Hi all,

Well if you buy it direct from CPW over the phone there is no cooling off period at all and it said so on the envelope with the Sim card in it which did make me stop and think for a few minutes but as this was my first device with 02 i really didn't have much choice unless i wanted to have to wait whilst it went back through the system. As before it arrived i tried to get one direct from an 02 shop but because i had just got one they wanted £150 deposit due to just getting a first contract already with them which obviously wasn't going to happen well not from me it wasn't. Luckily the Streak has been all i could of wanted and then some and i must be lucky as so far my 02 reception has been good and averaging just below 2mbps but then i am on a Mobile Broadband and not a smart phone tariff not sure if that makes any difference or not.

Any item bought over the internet can be returned within 14 days in the UK

All CPW telephone and online sales are covered by the distance selling act within the UK. You must return the item in unused condition for this to apply, and if you open the sim card and use it you will receive a bill for all used airtime and data. This must be done within 7 days of delivery or attempt of first delivery.

Hope this clears things up for ppl.

This means that if you want to change your product for something else, you'll need to return it for a full refund and then make a new purchase. You may lose the phone number you were given, you may have to take an extra credit check, and the whole process may take a few days longer than if you were doing a straight exchange.

Ya missed the bottom bit out... basically what it means is you cannot exchange on certain networks. It is to do with the systems and tariff variations.

Everything you buy over the net and the phone is covered by the distance selling act, so you can return the handset but you also have to return the connection. hence the warning on the sim card pack. You cannot just walk into store and exchange the handset for another one, the whole connection must be returned and disconnected.

A "return and disconnect" whens you can return under the distance selling act, but then must reapply for a new connection.

Sorry if its all a bit confusing its all the different network policies.. you should try working with it all.

I missed that off for a reason - O2 are not included as one the networks which do not allow exchanges, so the last paragraph is not relevant to this thread.

Can understand though that different T&C will apply to a network contract (i.e. service) and opposed to a phone (i.e. goods) under SoGA and DSR, so not surprising the whole thing is a minefield of varying interpretation.

I'll dig out the now put away box with the envelope the Sim card came in and show you what it actually says but you see my point is if i can't open the box put the Sim in and use the device how can i know if it's any good or not? simple answer is i can't. Now when i got my Nexus One by phone form VodaFone it arrived i set it up and used it for a few hours and was able to discover terrible reception issues with it not holding a Network signal. So it went back in the box and was arranged to be sent back the next day with no cost to me at all. Thankfully the Streak has been all i could of hoped for and more but had it not once I'd tested it i would of been stuck in a 24 month contract and having to sell the Streak myself.

Again I think thelankygeek is putting his own interpretation on CPW's policies. In fact they say you CAN open the box to try the phone. From the same pages as previously linked::

. But you can't make any calls or send texts, or add anything to the phone's memory (such as saving numbers or taking a photo).

Being unable to extract the SIM card from its holder is a sneaky trick (and a bit of a con) as some phones won't even turn on without a SIM.

But I suppose you could leave the contract SIM intact, and use another O2 SIM (e.g. PAYG or 30 -day Simplicity with data) to test the phone, then do a factory reset before returning to erase the user history and call timers.

Of course if the reason for return is the inability to hold onto a signal, or other fault, rather than just a change of mind, then you have more rather more on your side and should be able to insist on a refund or replacement under SoGA under the critiria of "fit for purpose" and "acceptable quality".

On the other hand, all the above just demonstrates why you should avoid buying from CPW in the first place. O2 have none of these stupid clauses and are quite straight forward about their returns policy:

"How do I return or exchange my phone?

If you are not entirely satisfied with your purchase, you may return it to us within 14 days from the date of receipt to obtain a full refund or exchange. If you have used the SIM card, you will still have to pay for the pro-rated line rental amount and any charges outside of your allocated allowance.

Please contact Customer Services and they will advise you on how to process your return or exchange.

Please have the following information ready when you call:

* Order number

* Your full name and address

If you change your mind about a SIM Only tariff you may also cancel your contract within the first 14 days. "

Short and sweet and nice and clear. What's more, they don't try to rip you off by charging £429 instead of £399 for the SIM free phone!

I agree and doubt i would buy anything the same way again but the day before the Streak was due for release i couldn't find any 02 stores local to me that could confirm when it was coming in store and thought ordering by phone the day before release would mean i got it sent to me on the Friday for Saturday delivery which turned out to be wrong. But when i found one in stock at the 02 Store in Brent Cross they wanted a £150 deposit so I had to wait for the Streak i had already ordered to arrive on the Monday and when i saw the warning on the Sim card couldn't face returning it and waiting for the contract to be cancelled and working it's way through the system. Before i would of been able to get one direct from 02 as i said thankfully it's all been good and i love the Streak so it worked out fine but defiantly won't go down this route again for another phone. I don't feel ripped off about my deal though as i got my Streak for free on the £25pm 24 month Mobile Broadband tariff and with 3GB of data per month and view this as costing me £600 over two years with Interest free credit and the data as opposed to £399 or £429 just for the Streak for me this was the best deal for my Streak.
