Guest Azurren Posted January 12, 2011 Report Posted January 12, 2011 Well.. This is outrageous! http://support.t-mobile.co.uk/help-and-sup...at=DATA_CHANGES I'm sorry but this is just unacceptable, I found this link and am going to take the advice (But via Customer services / email.. I don't do letters :P) http://www.littlefluffytoys.com/?p=309 There is a thread open in the news section of this forum but just in case I am giving anyone here in the Blade section a heads up.. And wondering if anyone could give any advice on this :D

You didn't sign up for a 500mb a month limit.
Guest faulknerm Posted January 12, 2011 Report Posted January 12, 2011 T-Mobile are trying to use the farcical argument that the unlimited data allowance did not form part of the contract but was instead an additional service. Unfortunately for them, even their own customer service staff are contradicting this, and in writing too. :D

You didn't sign up for a 500mb a month limit. It depends on how underhanded they've been with the contract. You signed up for unlimited data usage (subject to fair usage policy). If they included a bit about "Acceptable usage policy is subject to revision at any time" then it becomes much harder to argue your case although with enough phone calls and shouting I think that you'd probably get off with it if you get it pushed high enough up the management tree. Doubt it'll be easy though. :S

Doubt it'll be easy though. :S I'm fairly sure they wouldn't want to see it tested in court for the sake of a few people getting out of their mobile phone contracts early. So you should be able to either get out or get them to honour the original contract if you're persistent enough. They can't override contract law with terms in their contract. I'll repeat that I'm not a lawyer, but both parties should agree to any changes in a contract. I'm just glad I didn't buy a T-mobile sim, I was tempted by their less limited 'unlimited data'. Are they still advertising it as unlimited data? It might be worth a complaint to the ASA. Phone companies & ISPs seem to each have their own definition of unlimited, all of them with limits. They should really be forced to stop using the word unlimited in their marketing. Edited January 12, 2011 by wbaw
Guest Simon O Posted January 12, 2011 Report Posted January 12, 2011 I'm so glad I'm on PAYG so I can just move to other networks easily. T-Mobile have really messed up by threatening customers that cancel with legal action if they don't pay the remaining fees!

Guest Lew247 Posted January 12, 2011 Report Posted January 12, 2011 another read that's well worth reading http://www.techradar.com/news/phone-and-co...a-tariff-921137 I'm glad I'm on giffgaff not only for the unlimited data and texts but also the fact they pay people for getting new members and also for helping out in the giffgaff forum
Guest lilzad Posted January 12, 2011 Report Posted January 12, 2011 ok just spoke to the customer service on t-mobile asking them if this will affect my contract as well, she told me yes it will and i said how comes as when i had signed up i was told i will get 3GB. she then told me that the internet was for browsing and not intended for downloads and watching videos. i then said ok and got of the fone looked at the terms and conditions of which i had signed up to and on there it clearly stats that you are not able to use the phone as a modem for pc ect and that you can not use it as peer to peer so where on there does it state anything about videos and downloads??
Guest Raspa Posted January 12, 2011 Report Posted January 12, 2011 http://www.bitterwallet.com/slow-and-stead...-the-race/39291 The problem with giffgaff are the people who go onto forums, spamming, telling everyone in any semi-related thread how they can refer you. All for a flim.

T-Mobile have really messed up by threatening customers that cancel with legal action if they don't pay the remaining fees! I am on a T-mobile SIM-only, 30 day rolling contract. As flexible as PAYG, but still 1 GB internet and more minutes. I checked on the T-mobile site, and my free Internet bolt-on is still 1GB?

Guest IronDoc Posted January 12, 2011 Report Posted January 12, 2011 (edited) Which's coverage is the best I've found (though I haven't read the links in this thread). Bottom line is we suffer 'material detriment' and so we are legally entitled to terminate. http://conversation.which.co.uk/mobile/mob...mers-contracts/ http://conversation.which.co.uk/mobile/mob...age-allowances/ Edited January 12, 2011 by IronDoc

I don't know if it will effect you but I am thinking unless it says "1gb" and not "unlimited" then it will be affected :D Lots of people are having problems. I really don't know if I can handle the added stress of all this but I am paying for the data! I make less than 2 phone calls a month and send 1 or 2 texts! Without data I am paying for NOTHING! No [/rant] I am far from finished :P

All for a flim. All for a film? Have I missed something? In regard to the post you quoted, I had a similar problem with Vodafone last year when they changed their fair use policy to a 500MB fixed limit, and got the contract cancelled with no penalty, yes they will argue it doesn't change the terms but it does, and did, the same with T-mobile
Guest Azurren Posted January 12, 2011 Report Posted January 12, 2011 “On Monday 10 January 2011 we announced that, in line with the rest of the industry, T-Mobile would be reducing its Fair Use Policy for data usage to 500MB a month for all mobile phone customers. Following a further review of our policy, these changes will now be introduced from 1 February, to new and upgrading customers only - not existing customers. There will be no change to the data packages for existing customers for the duration of their contract and we apologise for any confusion caused. The revision to the Fair Use Policy is designed to ensure an improved quality of service for all mobile internet users." Found on the original link
Guest Mit321 Posted January 12, 2011 Report Posted January 12, 2011 Found on the original link Yep they literally just posted that up, they've backed down and now its only for new or upgrading customers!

Guest stanno Posted January 12, 2011 Report Posted January 12, 2011 That's good for me. My contract's only a few weeks in. Hopefully things will be clearer by the end of the year when I re-negotiate. T-Mobile have made a total hash of this though and will have alienated a LOT of existing customers.

I used to recommend T-Mobile to everyone.. In fact I think I recommended it to someone on this board today/yesterday. Looks like GiffGaff is the only real choice for smartphones now :D

All networks do these things from time to time; this isn't Armageddon. i dont actually think it is a contact should mean a contact you cant wiggle out or go actually instead of giving you £30 quid a month as per the contact ill just give you £5 cos you dont need the money. wich is what there saying cutting down from 3gb to 0.5 gb and saying well you dont need the data annyway use your broadband if you cant why should they be able to ?
