Hi all

sej7278 asked will we be getting Libra 2.6.35 source code as it seems that runs Android 2.3.4?

Here's the official response:

The new Libra is not yet commercially available. ZTE will get the source code up online as quickly as resources make practically possible.

it says here that the libra will be hitting stores today or tuesday, so can expect the source code by wednesday?

The source code (or a link to it) will be in the box as required by the GPL.

Or have ZTE still not learned what the GPL means yet?

exactly, the source code should be available as soon as the phone is, not afterwards.

Well, not to be offensive or anything, but...

Copyright laws in Asia, in particularly far east, are not exactly, "respecting" of the laws etc, and thereby can do anything they like much to the annoyance of others.

Surely, ZTE can understand English and can read the GPL which is in English or do we need to have it translated into Chinese for them to point it out ..

Sorry for sounding harsh, but, we might as well be waiting forever until the cows come home...

After the skate code release,I would not expect too much here!

Maybe a link to a broken code,followed by some 404's

I also have a little bit of a problem that the community is placing it's faith in ZTE_SeanJacko to help us. Think about it, he works for AxiCom who represent ZTE as a client in order to raise their profile. Nowhere is it in his remit to get ZTE to provide what they are legally obliged to, he just needs to make them look good.

Things have gone very quiet in the Source Code - Questions thread. Sean has had more than 2 weeks to "confirm" the update he has been given yet has still not posted it and, more importantly, we still don't have access to the complete source as required by the GPL.

Since waiting patiently and engaging in conversation has produced nothing of any use I'll give it 1 more week before it's time to switch to a different tack. I'm thinking that reporting ZTE to gpl-violations.org and the Software Freedom Law Center combined with a news story to the usual tech sites.

True if they were selling the product only in Asia. However, since they are shipping worldwide it should be possible to get an injunction against them selling GPL violating products in markets where laws are followed. We just need a lawyer willing to take on the fight.

I am not sure if naming/shaming and threatening black-mail is the way to go... we're small fry unlike the big company that has sold millions of handsets, alone in this, we're just a small microscopic community. It might be better to instigate in a non-threatening manner, a petition online for the community to sign up to and from there, once a goal is achieved in collecting the email signatures, hand it over to ZTE. If no results come of it, then yes last resort, lodge it with gpl-violations.org and softwarefreedom.org.

From what I know of in relation to customs and traditions, the Chinese are not going to "lose face" on this one... :)

I'm all for an open and honest approach to resolving conflict but the ZTE side seems to be giving the community the finger. We asked very nicely in the source code - questions thread for a response and we got nothing back at all.

Me too, definitely all for transparency... and agree 100% that ZTE are giving the community the finger... I prefer a more softly softly approach :)

The question is this - Are ZTE who have just recently acquired an order for 2 million ZTE Blade V880 Smartphones from China Unicom (btw this is on twitter a while ago) going to listen to such a small community like us? or Is ZTE PR Sean Jacko going to keep running around ZTE's little finger on this one whereby feeding b.s to him and for him to relay that back to us as PR spin....?

Give it one week as you suggest - I will edit out the previous posting about blackmail then :)

If no response there and then, go for it and report them :)

lol, even motorola/htc are better than zte as far as supporting the community mods goes.

experia pro will be my next droid i reckon, certainly will never use or recommend zte again, especially after the skate farce.

Oh... dunno about HTC considering their latest brush with their latest vulnerability which is "apparently affects only the HTC handsets sold in the US"... :)

Disclaimer: I am only just repeating what is said on that AndroidPolice and also aint promoting nor advertising, just quoting "facts" but then again, never believe anything on the inter-tubez! :D :lol:

ZTE_SeanJacko, the Libra had been on sale for weeks in Hungary when you posted this thread & that version was available in the UK via Amazon. It's been on sale for months in Asia. Now it's been released in the UK. It has a 2.6.32 kernel & Android 2.2.2.

The 2.6.32 kernel source that ZTE has released doesn't have a working driver for the camera in the ZTE Libra. The GPL2 camera drivers in the kernel must have been modified in some way for the kernel that is distributed with the Libra & complete source code for that kernel has not been released. In my (non-legal) opinion this is in violation of section 3 of the GPLv2 license that the Linux kernel was given to ZTE under, which is the license that allows them to redistribute Linux (ie sell android devices).

'as quickly as resources make practically possible' means before the phone leaves the factory. It's not difficult to obey the GPL software license. Total cost to ZTE should be around $5-$10 us dollars, depending on how well they pay their chinese staff that are capable of uploading something to the internet. The cost of not doing it, is never being able to sell another Android device, or anything else based on Linux ever again, in any country that respects copyright laws, when they get taken to court.

Agreed.

ZTE is going to be a 1 hit wonder. They have managed to turn the community against them which is quite a good trick considering how easy it would have been to just answer our questions and produce the right source.

Nothing they have announced since the Blade is even close to something I'm interested in buying.

Maybe send it to ZTE first saying if they do not release the proper source code by x date, then you will send the complaint on to whoever it should go to. Give them a last chance to start complying with the rules. Make it clear that if they don't release the source code at the same time as the software in future, then the complaint will still be sent.

It won't work

source code has to correspond *exactly* with the binaries. (Not when you feel like it same time or source first).

(i.e if they distribute binaries on a given site (e.g ztesweden.se they must also provide source code for all GPL / LGPL'ed parts (at a minimum) by the same method of distribution).

If they provide the code on a device they have to provide the GPL notice somewhere (and offer the source for a reasonable distribution fee).

Might be some other things they have to provide also (any .o's of proprietary code that links to LGPL'ed libraries so a new version of the library can be used if you so wish).

The sources provided must be for the exact binary in question every time.

I guess ZTE wouldn't like it if someone completely cloned their technology. (i.e read the whole flash over jtag build a clone device sell it much cheaper, no R&D costs)

(If you don't respect other peoples copyright you cannot expect anyone else to respect yours).

Not that this forum is anything other than large scale copyright infringement when it comes to ROM.

There again if a business model relies on something its reasonable to expect a higher standard than people doing things as a hobby.
