I doubt if they would do anything unless you had a stolen phone or SIM perhaps ?

I didn't miss your point, but maybe I wasn't too clear on my reply.

Of course they can see what you are uploading, everything is traceable on the internet. Your data may be encrypted though.

All you are doing is storing your details on a server somewhere when you do an Orange Backup.

The data is protected however by The Data Protection Act.

The Police or FBI etc can request to see this information if they believe a crime has been committed.

soooooooooohhh if they mess with my phone they could be messing with the Data Protection Act.

I don,t think they will mess with that

The DPA doesn't mean they can't examine what you are uploading - if they can justify to a judge that they have either "The Need to Know" or "The Right to Know" then they can do anything they want with the information.

They can't even give it to the Police easily - doing so requires A LOT of consideration by a senior judge.

Your phone has nothing whatsoever to do with the information stored therein. Orange has no legal rights to fiddle with your SPV, it's yours. But they can do whatever they want with the SIM card. IF they think you're up to something dodgy then they can suspend or terminate your service without notice.

But with all that said, Orange have a responsibility that only you and they have access to said information, any breaches are dealt with VERY harshly; we're talking prison terms and unlimited fines.

The DPA was put in place to stop ANYONE who is not the actual owner of the phone from either tampering with / reading/ giving out your info.

Any violation of this would result in either immediate dismissal from the company or prison.

There is no need for orange to trace what you are downloading from the net, even if someone complained about the content of your downloads.

As was said before, even the police have trouble obtaining info.

You are the only person who has access to anything on your account, not even Orange are supposed to look without consent.
