Does anyone have copies of initial Orange advertising?

Hi - I've put this comment in a few threads, but it is probably better in a new one.

Does anyone have screen-dumps or other copies of the initial Orange advertising for the SPV? Specifically I am looking for anything from Orange that actually says the phone has (a) HSCSD or High Speed Data* (:D Voice dialling.

*Note that it is quite possible the phone does this - it's just I can't get it to do it yet, and the lady I spoke to on 156 said they have been told to tell everyone to use only 9600 connection settings.

And even though I have dumped the terms and conditions saying VAT is included in all prices, I can't actually find anywhere on the Orange site that says the SPV GPRS access pack is £6 per month to couple with that - can anyone give me a link?

I'm not currently unhappy with the phone, just that should the poop hit the spinny thing and I want to stand up for my consumer rights, I wouldn't mind archiving some evidence. I also volunteer to hold them electronically for everyone on a web-site who might need it.

I already have the current web-site list of features imaged, which includes Fax (the official MS rep on the Usenet groups has said the phone is not Fax compatible - again I haven't tried it from my laptop yet).

I thought the £6 GPRS bundle was inclusive of VAT too!.....grrr

I bought my phone from www.mobileshop.com

On the SPV product page, the prices do not list whether VAT is added or not

but in the terms and conditions page

It says on Clause 7 7.

7.1. Unless we indicate otherwise, all prices stated include VAT and delivery within the United Kingdom (excluding Eire). All Errors and Omissions are excepted.

So what does "Omissions are expected" mean?

Errors and Omissions Excepted, or E&OE, is the catch all "if we make a blinding error, then you knew that it wouldn't be covered by those terms and conditions". It is usually used to cover a company if they advertise, say, a £1000 TV at £10 just because some dolt in the printing company puts a decimal point in the wrong place.

It wouldn't override statutory rights, and therefore, in this case, it wouldn't reasonably be able to use it to say "oh we meant to put +VAT on the page - it was an error we didn't".

If Orange insist it is £6 + VAT and we can show them advertising material and terms and conditions that say we were led to believe it was to be £6 including VAT, then I'd say they don't have a leg to stand on - it is not like we are making an unreasonable assumption which E&OE would cover. It looks as if they are backing down anyway, so I wouldn't panic - I guess they'll just charge everyone +VAT and those that complain, they'll refund.

I am sure it is just coming down to the fact that the SPV has mainly been targetted as a business phone, and everything else on business tarrifs is quoted as +VAT.

The only other thing I could imagine Orange could do is insist you have to pay £6+VAT from now on, as they have told you that, but then, as per their own terms and conditions you sign in the shop, you can just terminate your contract with no penalty and that is not in their interests.

Anyone who has picked up the phone in the shop and the assistant has said the pack is £6 per month is covered anyway - it would form part of the agreement you signed. Its only an issue for those who have ordered online.

I'm no lawyer, so anyone depending on what I say above better check it with one first :D
