if the headphone profile gets stuck do i have to have warranty to return it?

do i have to send it to HTC or are there any other ways?

try to clear the fault buy pluging in the headphones and pulling them out again several times........

i understand that you can blow the socket etc

but if it gets permanently stuck i wanted to know if i could take it back without a warranty

As long as you bought the phone you will have a warrany but you will need to send the phone away for repair.

Your other option is to get emergency care @£30 then pay £5 a moth for a years cover of care.
