Guest Monolithix [MVP] Posted August 11, 2003 Report Posted August 11, 2003 Just a feature that wasn't implemented. I think officially you have to inform someone that a call is being recorded, otherwise it is dismissable as evidence in a court of law, etc etc....

I remember seeing adverts for the "conversation amplifiers" (a directional microphone, amplifier and headphones). Anyway, these said that someone in the conversion must know it is being recorded. I think as long as one person knows, it's fine. Call centres just tell you to give them a more of a leg to stand on, just in case.

Guest solo Posted August 11, 2003 Report Posted August 11, 2003 It is illegal to eavesdrop on a telephone conversion without informing the parties involved in that conversation. This is why call centres have the annoucement to tell you that your call may be monitored for training purposes, etc. It is also why the police, MI5, etc. have to obtain special permission (but not your permission :) !) to tap your phone. However, there are many loop holes in the law. For example, an employer can monitor your calls if they believe you are up to no good (the clause is there because if they told you that they were going to record your naughty conversations, you wouldn't make them :o ). Therefore I don't see how recording your own conversation can be viewed as illegal ... Sounds like this is just another unimplimented feature.

There was something recently about guidelines stating that you can only monitor if you suspect wrongdoing. I can't remember if it was proposed or actually passed as the official rules.

Yeah - its official. Something called RIPA 2000 (Regulation of Investigatory Powers Act - I think!) As I mentioned earlier there are a number of get out clauses, one of them being the suspected wrong doing. Another is that employers don't have to tell you they are monitoring your telephone calls and email, if the telephone and email is internal only. If they are monitoring telephone and email that goes out of the company they have to tell you about it. Solo
