I'sn't it best just to download from Orange themselves?

DO NOT download illegal files. period. why screw up your phone and get "busted" by the network operator in case if your phone gets busted? you will not only void your warrenty but apperently also will fine you for doing this.

If you are an MVP etc... then they will have sent details on what to do.

That's all I have to say. Either wait until your contract expires to get a new device with WM5 (i.e imate SP5m) or buy the device with WM5

as well as this, I know a good friend who works for a company who gives their employees the smartphones and thats pretty much what they were saying too. And to add to that - the same for me for the company i work for!

But orange themselves have said this - its to crack down, in a sense, illegal software (damn right should be too!) and also the time spent to replace the hardware on the phone due to illegal OS's being installed on the phone. It's not easy to "wipe" it off.

I have seen WM5 on a C500 and it screws up the camera and the downsides fr outweigh the upsides.

Even if it wasn't illegal I would not recomend it to anyone.

Errrm, but *how* can they fine you? Under what mechanism of law or their own terms? They are not the copyright holders of the illegal rom if you are using one so cannot sue you for using that, and you are the owner of the hardware, so what business is it of theirs? And how would they know? So how can they 'crack down'? Most people who hack their roms wouldn't be daft enough to send it back to HTC for repair without downgrading, and Orange don't do any repairs themselves, so again, how would they know? They can't interorgate a handset over the air to find it's OS.

Saying your source is 'orange' and then adding no details isn't very helpful. Web address? Legislation? I can't find anything in orange UK's TOS that says they can 'fine' you for using illegal software on a handset on their network. They can shut your handset off the network, but not fine you.

4.6.2 you haven't complied with one or more of the terms of your Contract and do not correct the breach within 7 days of being asked by us in writing to do so. "

Notice under clause 4.6.1, that clause 6.4.6 isn't listed as a valid reason for terminating your contract without notice. But they could ask you to stop using the phone and you'd have seven days to do so. If they knew you were using it ;-)

The only thing I can think of that it may affect is a handset's BABT approval in this country, and even then, that's not upto the networks to regulate / enforce, it's the manufacturer's that apply for the licences / imei allocations.

According to their own terms, the maximum liability is your remaining line rental

*if* they cut you off. Which from my reading of the terms, they can't for using 'illegal' software on a handset. They certainly can't fine you from what I've read. If someone has some PROOF of this from Orange post it or link to it from here. Please don't just post anecdotal evidence, it doesn't help.
