Tomtom says that the software is not transferable between purchases. That means whatever Tomtom software you see on eBay are illegall. You're better off with buying a legit copy from authorised outlets and it will give you full support & upgrades in case you need it.

Fortunatly copyright law offers protections - see "first sale doctrine". A purchaser is permitted to sell a legally acquired copy of a protected work WITHOUT PERMISSION from the copyright owner. Fortunatly the rights given to you by law cannot be revoked via a EULA, hence any restrictions TomTom may wish to impose on you regarding the sale of the software are not legally binding. I believe in European law it is known as "Exhaustion of Rights". Of course if the guy is not selling the original product but a copy, it is a clear case of copyright infringment.
