Tomtom says that the software is not transferable between purchases. That means whatever Tomtom software you see on eBay are illegall. That means whatever Tomtom software you see on eBay are illegall. TomTom can say what they like, and I'm sure they wish it wasn't possible to re-sell their software. Fortunatly copyright law offers protections - see "first sale doctrine". A purchaser is permitted to sell a legally acquired copy of a protected work WITHOUT PERMISSION from the copyright owner. Fortunatly the rights given to you by law cannot be revoked via a EULA, hence any restrictions TomTom may wish to impose on you regarding the sale of the software are not legally binding. I believe in European law it is known as "Exhaustion of Rights". Of course if the guy is not selling the original product but a copy, it is a clear case of copyright infringment.
