16gb my storage dead for the 3RD TIME!!

i love this phone very much despite of the lousy samsung touch wiz, custom roms created here compensates for its short comings. but the hardware keeps failing. i have a 1 year warranty, what im asking is, is there a law to refund? thesame hardware keeps failing over and over again. what happens when im out of warranty? i would like to trade this phone to samsung galaxy.
