I'm thinking along the lines of ebayers for instance that could end with a barred handset unknowlingly, and end up locking their old phone as well through no fault of their own. It would make selling second hand handsets very difficult... Damn those thieves :/

Yeh but if you read the law it states if you have changed the IMEI number then its illegal, so going away and coming back after changing it still means you HAVE changed it and hence contrevenes the law!
